A seller disclosure document records known defects and important property information. While the voetstoots clause limits liability for unknown defects, sellers must disclose known issues.

What to disclose

  • Structural defects
  • Water damage or damp
  • Roof leaks
  • Boundary disputes
  • Unapproved alterations
  • Pending municipal actions
  • Neighbourhood nuisances
  • Borehole / septic known issues on smallholdings

Failure to disclose known defects can result in legal claims after transfer. Have your OTP and disclosure reviewed with your conveyancer.
