South African rental practice is governed mainly by the Rental Housing Act and your written lease. Always get the agreement in writing.
Deposits
- Deposits are commonly equal to one month's rent (sometimes more for furnished or pet-friendly stock)
- Ask which interest-bearing account holds the deposit
- Return of deposit depends on the outgoing inspection and unpaid amounts
Lease essentials
- Parties, address, rent amount and due date
- Lease start/end and notice period
- Utilities, garden and maintenance duties
- Pets, sub-letting and early termination
- Access for landlord inspections (reasonable notice)
Disputes
If you cannot resolve a deposit or lease dispute directly, the Rental Housing Tribunal may assist. Keep photos, emails and signed inspection forms.
